These Terms of Service are the agreement between you and Tumbler Lane when you use tumblerlane.com or buy drinkware from us. They cover how orders are formed, prices, payment, delivery, returns, what you may and may not do on the site, and what happens if something goes wrong. We have tried to write them in plain English. Where a section points to a more detailed policy, such as our Shipping & Delivery or Refund Policy, that policy forms part of these Terms.
“Tumbler Lane”, “we”, “us” and “our” mean the business operating this store: Tumbler Lane, 4555 Mansell Rd., Alpharetta, GA 30022, US, contactable at support@tumblerlane.com. “You” means the person using the site or placing an order. “Products” means the insulated tumblers, water bottles, can coolers, lids, straws, toppers, boots, sleeves and other items listed for sale on the site.
The short version
- By using the site or placing an order you agree to these Terms. If you do not agree, please do not use the site.
- You must be at least 18, or the age of majority where you live, to place an order.
- Prices are in US dollars. Shipping is free to the United States, Canada, Australia and New Zealand; we do not ship elsewhere.
- Orders ship in 1–3 business days and take 7–14 business days in transit.
- You can cancel or change an order within 24 hours if it has not shipped, and return any item within 60 days of delivery with return postage paid by us.
- Refunds are processed within 7 days of approval to your original payment method.
- These Terms are governed by the laws of the State of Georgia, USA, without taking away any consumer rights you have where you live.
1. Using the site
You may browse tumblerlane.com, create an account and buy products for personal, household or gift use. You agree to give accurate information when you check out or create an account, to keep your account password confidential and to tell us promptly if you think someone else has used your account. You are responsible for activity under your account unless it happened because of our failure to protect it.
We may update the site, add or remove products, or suspend parts of the site for maintenance. We try to keep the site available and accurate, but we do not promise that it will always be uninterrupted or free of errors. If you spot an error, telling us helps everyone.
1.1 Eligibility
To place an order you must be at least 18 years old, or the age of majority in your state, province or country, and able to enter into a binding contract. Children are welcome to use our cups, but purchases must be made by an adult.
1.2 Buying for resale
Our store is set up for personal and gift purchases. If you want to buy in quantity for a team, an office or an event, contact us first and we will tell you what is possible. We may decline or limit orders that appear to be placed for resale.
1.3 Accounts are optional
You can check out as a guest without creating an account. An account simply saves your addresses and lets you see past orders in one place. You can ask us to close your account at any time; we keep order records only as long as the law requires, as explained in our Privacy Policy.
2. Products, photos and descriptions
We describe products as accurately as we can. Each product page lists details such as capacity, lid style, colour, materials as stated by the supplier, care instructions and, where measured, the base size relevant to cup holders. Some practical notes:
- Capacity is stated in US fluid ounces and refers to the nominal size of the cup. Usable volume is a little less once a lid and ice are in place.
- Colours on screen depend on your device and lighting. Powder-coated and matte finishes can look different in daylight and indoor light. If a shade matters, read the colour note on the product page, and remember that colour exchanges are covered by our 60-day returns.
- Temperature performance of insulated drinkware depends on the starting temperature, the amount of ice, how often the lid is opened and the surrounding temperature. We do not promise a number of hours unless a product page states one from the supplier’s testing.
- Lids: straw lids and slider lids are designed for upright use. Only lids described on the product page as sealing closed are intended to be carried on their side.
- Hot drinks: use lids described as suitable for hot drinks, open them slowly and away from your face, and take extra care with children.
- Care: follow the care instructions on each product page. Hand washing with a bottle brush is the safe default for vacuum-insulated drinkware.
If a product you receive is materially different from its description, it is covered as “not as described” under our Returns & Exchanges Policy, and you are entitled to a replacement or full refund.
3. Prices and availability
All prices are shown and charged in US dollars (USD). If your bank or card is in another currency, your bank converts the amount and may charge its own fees; we do not add conversion fees. Prices may change at any time, but the price that applies to your order is the one shown at checkout when you place it.
Shipping to the United States, Canada, Australia and New Zealand is free, with no minimum spend. Any sales tax that applies to an order is shown at checkout before you pay. Orders delivered outside the United States may be subject to import duties, taxes or customs fees charged by the destination country, which are not included in our prices and are paid by the recipient.
Products are available while stock lasts. Showing a product on the site does not guarantee that it is in stock in every capacity and colour at the moment you order. If an item you ordered becomes unavailable, we contact you and offer an alternative or a full refund for that item.
3.1 Pricing errors
Despite our care, a product could occasionally be listed at an obviously wrong price because of a technical or typing error, for example a 40 oz tumbler shown at $0.40. If that happens, we are not required to sell at the wrong price. We will contact you before shipping and give you the choice of continuing at the correct price or cancelling for a full refund.
4. How an order becomes a contract
- When you place an order, you are offering to buy the products in your cart at the prices shown, including any tax shown at checkout.
- We send an automatic order confirmation email. That email confirms we have received your order; it is not yet acceptance.
- Your order is accepted, and a contract is formed, when we ship the products and send you a shipping confirmation email, or when we otherwise confirm acceptance in writing.
We may decline or cancel an order before acceptance, for example if a product is unavailable, if payment cannot be verified, if the delivery address is outside the countries we serve, if there is a pricing error, or if we reasonably suspect fraud. If we cancel after you have paid, we refund the full amount within 7 days.
5. Payment
Payment is taken at checkout through the payment options shown there. Payments are handled by the payment provider, which processes your payment details under its own terms and security standards; we do not store full card numbers. By submitting payment you confirm you are authorised to use the payment method. Details of the methods currently available are on our Payment Methods page.
If a payment is declined or later reversed, we may cancel or hold the order. If you believe a charge is wrong, please contact us first; we can often fix it faster than a card dispute, and contacting us does not affect your rights with your bank.
6. Shipping, delivery and risk
We ship from the USA to the United States, Canada, Australia and New Zealand. Orders are processed within 1–3 business days of payment confirmation and then take 7–14 business days in transit. These are estimates, not guaranteed delivery dates. Full details, including what we do about late, lost and damaged parcels, are in our Shipping & Delivery policy.
Responsibility for loss or damage passes to you when the products are delivered to the address you gave us. Until then, if a parcel is lost or damaged in transit, we replace or refund it as described in our policies. You are responsible for giving us a correct and complete delivery address; if a parcel cannot be delivered because of an address error, we will work with you to reship it, and reshipment is free if the error was ours.
7. Cancellations, changes, returns and refunds
- Cancel or change: within 24 hours of placing the order, if it has not shipped. See Cancel or Change an Order.
- Returns and exchanges: any product, for any reason, within 60 days of delivery. We provide a prepaid return label, so return postage is free. See Returns & Exchanges.
- Refunds: processed within 7 days after the return is received and approved, a claim is approved or a cancellation is confirmed, to your original payment method. No restocking fees. See Refund Policy.
- Damaged, faulty, wrong or lost items: report within 60 days of delivery for a free replacement or full refund.
These commitments are in addition to any rights you have under consumer protection laws where you live. Nothing in these Terms takes those rights away.
8. Discounts and promotions
From time to time we may offer discount codes or promotions. Each one has its own conditions, such as an end date, eligible products or a limit of one use per customer, which we state where the promotion is offered. Codes have no cash value, cannot be combined unless we say so, and cannot be applied to orders already placed. If you return items bought with a discount, the refund is based on the amount you actually paid. We may end a promotion early if it is being misused, for example through automated or bulk redemptions.
9. Reviews, photos and content you send us
If product reviews are enabled, you may submit a review of a product you bought. Reviews must be honest, based on your own experience and free of offensive, unlawful or misleading content, personal information about others and links to other websites. We do not edit reviews to change their meaning and we do not publish reviews we have paid for or written ourselves. We may decline or remove reviews that break these rules.
By submitting a review or other content for publication, you give us a non-exclusive, royalty-free licence to display it on the site in connection with the product. Photos you send to support for a claim are used only to handle that claim, as described in our Privacy Policy, and are not published.
10. Intellectual property
The Tumbler Lane name and logo, the text, page layouts, original graphics and other content of the site belong to Tumbler Lane or are used with permission, and are protected by intellectual property laws. You may view and print pages for personal use, for example to keep a copy of these Terms or your order. You may not copy, republish or use our content commercially without written permission. Product names and any third-party brands mentioned belong to their owners; any mention is descriptive only and does not imply endorsement. Our Intellectual Property Policy and DMCA notice page explain how to report content you believe infringes your rights.
11. Acceptable use
When using the site you agree not to:
- break any law or encourage anyone else to do so;
- place fraudulent orders, use payment methods you are not authorised to use, or misuse returns and refunds;
- try to gain unauthorised access to the site, other customers’ accounts, our admin area or our systems;
- interfere with the site’s security or performance, including by introducing malicious code or overloading it with automated requests;
- scrape, copy or harvest content or data from the site by automated means, other than ordinary search engine indexing that respects our robots.txt file;
- impersonate anyone or misrepresent your connection with any person or organisation;
- post or send content that is abusive, defamatory, obscene or infringes someone else’s rights.
We may suspend or close accounts, cancel orders or refuse service where we reasonably believe these rules have been broken. Where possible, we will tell you why.
12. Safe and sensible use of drinkware
Insulated drinkware is simple, but a few common-sense precautions matter. Do not microwave stainless steel products. Do not put carbonated drinks into a sealed vacuum bottle unless its product page says the cap is designed for them, because pressure can build up. Do not freeze products filled with liquid. Keep small parts, such as straw toppers and gaskets, away from young children. Supervise children with hot drinks. Inspect lids and straws regularly and replace them if they crack. Using a product against its instructions may mean a resulting fault is not covered as a defect, but it never affects your 60-day right of return.
12.1 Electronic communications
When you place an order, create an account or write to us, you agree that we may communicate with you electronically, by email or through notices on the site, about your order, your account and these Terms. Order confirmations, shipping notices, return labels, refund confirmations and policy updates sent by email satisfy any legal requirement that such communications be in writing. Please keep your email address up to date and add support@tumblerlane.com to your contacts so that important messages do not land in a spam folder. We do not send marketing emails unless you have asked to receive them.
12.2 Feedback and suggestions
We read every suggestion, whether it is a colour you wish we stocked, a lid that would suit your commute better or a page that confused you. If you send us ideas or feedback, you agree that we may use them to improve our products and the site without owing you payment, and we will not publish your name with them without asking. Feedback does not need to be formal; a short email is perfect.
12.3 Third-party services
Some parts of the shopping experience rely on other companies, such as payment providers, carriers and their tracking pages. When you use their services, their own terms and privacy policies apply alongside ours. We choose these providers carefully, but we are not responsible for the content of their websites or for their own policies.
13. Disclaimers
We provide the site and its content “as is” and “as available”. To the extent permitted by law, we do not make promises about the site beyond those in these Terms and our policies, and we exclude implied warranties to the extent the law allows. Products are covered by the commitments in our policies and by any warranties that cannot be excluded under the consumer laws where you live, including, where applicable, the guarantees under the Australian Consumer Law and the New Zealand Consumer Guarantees Act 1993, and implied warranties under the laws of your US state or Canadian province that cannot lawfully be limited.
14. Limitation of liability
To the extent permitted by law, Tumbler Lane is not liable for indirect, incidental, special or consequential losses, such as loss of profit or loss of data, arising from your use of the site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits or excludes liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for breach of non-excludable consumer guarantees. Where the law allows us to limit our liability for breach of a consumer guarantee, our liability is limited to replacing or repairing the product, or refunding its price.
15. Indemnity
If you break these Terms or the law when using the site, and that leads to a claim against us by someone else, you agree to cover our reasonable losses and costs arising from that claim, to the extent the law allows. This does not apply to claims caused by our own fault.
16. Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, natural disasters, carrier disruptions, strikes, power or internet failures, government action or public health emergencies. If such an event affects your order, we will tell you, keep you updated, and give you the option of cancelling for a full refund if the delay becomes significant.
17. Governing law and disputes
These Terms and any dispute about them or about an order are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law rules. If you are a consumer living elsewhere, you also keep the protection of any mandatory consumer laws of the place where you live, and you may bring a claim in your local courts where those laws allow.
Before starting any formal proceedings, please contact us at support@tumblerlane.com and give us a chance to resolve the problem. Most issues with drinkware orders, such as a dented cup, a missing lid or a late parcel, are settled within days. If we cannot resolve a dispute informally within 30 days, either of us may take it to a court of competent jurisdiction in the State of Georgia, or, if you are a consumer, to the courts where you live as permitted by law. Small claims courts remain available to both of us.
18. General terms
- Entire agreement: these Terms, together with the policies linked in them and your order confirmation, are the whole agreement between us about your order.
- Severability: if a court finds part of these Terms unenforceable, the rest stays in effect.
- No waiver: if we do not enforce a right straight away, we can still enforce it later.
- Transfer: we may transfer our rights and obligations under these Terms to another business, for example if Tumbler Lane is sold, provided your rights are not reduced. You may not transfer your rights without our written consent.
- Notices: we will contact you at the email address on your order or account. You can contact us at support@tumblerlane.com or by post at the address above.
- Language: these Terms are written in English, which is the language of the contract.
19. Changes to these Terms
We may update these Terms, for example to reflect a new payment method, a change in the countries we ship to or a change in the law. The date at the top shows the latest version. Changes apply to orders placed after the update; the Terms in force when you placed an order apply to that order. If we make a significant change, we will highlight it on the site.
